IndigenousDreamWalk.com Terms of Use

Last Updated: October 2, 2026

Please review these Terms of Use carefully.

IMPORTANT: THESE TERMS REQUIRE ALL DISPUTES TO BE RESOLVED THROUGH MANDATORY INDIVIDUAL ARBITRATION. BY AGREEING TO THESE TERMS, YOU AND INDIGENOUS DREAM WALK (IDW) EACH WAIVE THE RIGHT TO SUE THE OTHER IN COURT OR PARTICIPATE IN A CLASS ACTION.

1. Introduction

Terms of Use

Welcome to the websites and digital services of Indigenous Dream Walk. These Terms of Use (“Terms”) govern your access to and use of all Indigenous Dream Walk websites, mobile applications, and online platforms (collectively, the “Sites”).

By accessing or using the Sites, you acknowledge that you have read, understood, and agree to be bound by these Terms. You represent and warrant that you possess the legal capacity to enter into this agreement. If you are under the legal age of majority in your jurisdiction, you affirm that your parent or legal guardian has reviewed and accepted these Terms on your behalf. If you do not agree to these Terms, or if you violate any provision herein, your authorization to access or use the Sites is immediately and automatically revoked.

Certain services, including the purchase or use of Gift Cards, may be subject to supplemental terms. Any such additional terms will be provided to you in connection with those services and are hereby incorporated into these Terms by reference.

1. Definitions

For the purposes of these Terms, the following definitions apply:

  • “Indigenous Dream Walk,” “we,” “us,” and “our” refer to IndigenousDreamWalk.com, Indigenous Dream Walk Stores, LLC, their current and future subsidiaries and affiliates, and their respective directors, officers, employees, and agents.

  • “IDW Products” means any goods, merchandise, or services offered for sale or distribution by Indigenous Dream Walk and its affiliated artisans.

·       “You” and “your” mean any individual or entity that accesses or uses the Sites or receives notice of these Terms.

2. Scope and Amendments

  • “Terms of Use” means these Terms of Use, alongside all other operational policies, guidelines, and terms posted across the Indigenous Dream Walk Sites, including any subsequent amendments or updates.

  • Amendments and Updates: We reserve the right to modify, amend, or update these Terms of Use at our sole discretion. Notice of any material revisions will be provided by reasonable means, including but not limited to updating the "Last Revised" date and posting the amended terms directly on the Indigenous Dream Walk Sites.

  • Dispute Resolution Preclusion: Revisions to these Terms will not apply retroactively to any active disputes or claims that arose prior to the date the revised Terms were published or otherwise communicated to you.

  • User Responsibility: You maintain the sole responsibility to review IndigenousDreamWalk.com periodically to stay informed of any changes. Your continued access to, use of, or interaction with any Indigenous Dream Walk Site or service following the publication of revised Terms constitutes your explicit and legally binding acceptance of those modifications.

3. User Accounts and Platform Access

  • Information Accuracy: You certify that all content, data, and information you provide through the Indigenous Dream Walk Sites is accurate, current, and complete. You agree to update your information promptly to maintain its accuracy.

  • Account Security: You assume sole responsibility for maintaining the confidentiality and security of your account credentials, including your username and password. Indigenous Dream Walk expressly disclaims liability for any losses, damages, or unauthorized transactions resulting from the compromise of your credentials or shared access to your device.

  • Payment Terms: Your utilization of any credit card, debit card, or alternative payment method on the Sites is governed strictly by your independent agreement with the respective financial institution or payment processor.

  • Termination and Platform Modifications: We reserve the right, at our sole discretion and without prior notice or liability, to suspend, restrict, or terminate your account or access to the Sites. Except where prohibited by applicable law, we reserve the right at any time to:

1.    Modify, restrict access to, or permanently discontinue the Indigenous Dream Walk Sites or any portion thereof.

2.    Impose, modify, or waive any fees or charges for services offered through the Sites.

4. User Submissions: Comments and Ideas

A. Submission Guidelines and User Responsibility

  • Language Requirement: Indigenous Dream Walk provides functionality for users to submit comments, ideas, feedback, and other content through the Sites. All written submissions must be authored exclusively in English.

  • Liability for Submissions: You retain sole and exclusive responsibility for any comments, ideas, or content you submit. You affirm that all submissions comply with these Terms of Use and that you possess all necessary legal rights, licenses, and permissions to publish them.

  • Content Integrity: You are responsible for ensuring that your submissions are lawful, accurate, appropriate, original, and do not infringe upon the intellectual property or proprietary rights of any third party.

B. Proprietary Rights, Licensing, and Indemnification

  • Grant of License: By submitting comments, ideas, or other content, you grant Indigenous Dream Walk an irrevocable, royalty-free, worldwide, perpetual, unrestricted, non-exclusive, fully transferable, and sublicensable right to use, reproduce, modify, adapt, publish, edit, translate, distribute, publicly perform, publicly display, and otherwise process that content. This license applies to any media, format, technology, or forum now known or hereafter developed.

  • Operational Use: This license expressly permits Indigenous Dream Walk to utilize your submissions to provide, improve, optimize, and maintain the Sites, as well as to develop new features, products, or services without obligation or compensation to you.

  • Representations and Warranties: You represent and warrant that you own or legally control all rights to the submitted content, that the content is accurate, and that its deployment will not violate these Terms, cause injury to any individual or entity, or harm any Indigenous Dream Walk Site or physical retail location.

  • Indemnification: You agree to defend, indemnify, and hold harmless Indigenous Dream Walk from and against any and all claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or resulting from any content you submit.

C. Prohibited Content and Conduct

You expressly agree not to submit, post, transmit, or otherwise make available any content in connection with the Indigenous Dream Walk Sites that:

  • Misrepresents Facts: Is false, fraudulent, inaccurate, deceptive, or misleading.

  • Compromises Privacy: Contains your full name, contact information, or any other confidential or personally identifiable information (PII) belonging to you or any third party.

  • Violates Legislation: Violates any applicable local, state, federal, or international law, statute, or regulation.

  • Contains Explicit Material: Is obscene, indecent, pornographic, lewd, or otherwise objectionable.

  • Harasses or Discriminates: Harasses, degrades, intimidates, defames, or discriminates against any individual or group based on religion, gender, sexual orientation, race, ethnicity, age, or disability.

  • Promotes Violence: Is violent, threatening, or incites violence or unlawful actions against any individual or group.

  • Includes Unauthorized Commercialization: Contains advertisements, promotional materials, commercial solicitations, or spam links to external websites or individuals without the express prior written consent of Indigenous Dream Walk.

  • Involves Impersonation: Impersonates any business, individual, or entity, including Indigenous Dream Walk, its affiliates, employees, or authorized agents.

  • Breaches Internal Policies: Violates any active policy, guideline, or rule published on the Indigenous Dream Walk Sites.

  • Disrupts Platform Operations: Is intended to harm, damage, disable, overburden, or otherwise disrupt the functionality of the Indigenous Dream Walk Sites, our infrastructure, or our corporate partners.

 5. Content Monitoring and Platform Enforcement

  • Right to Monitor: Indigenous Dream Walk reserves the right, but does not assume the obligation, to monitor, review, audit, and analyze user-generated content, comments, and platform access metrics at its sole discretion. This evaluation is conducted to ensure strict compliance with these Terms of Use and all applicable corporate policies.

  • Content Moderation and Removal: We reserve the right to move, edit, refuse to publish, or permanently remove any user submission or comment at any time and for any reason without prior notice. This includes, without limitation, content that violates these Terms or raises potential legal, regulatory, or operational concerns.

·       Liability and Indemnification: Our monitoring does not limit your responsibility for the comments or content you submit. You remain solely liable for your submissions and agree to defend, indemnify, and hold Indigenous Dream Walk harmless from claims, liabilities, or losses arising from them.

6. Product Listings and Informational Materials

·       Purpose of Content: Indigenous Dream Walk and its suppliers, artisans, and licensors offer informational materials, product descriptions, and products through the Sites. Informational materials are provided solely for educational and general informational purposes, while product listings constitute invitations to make an offer to purchase.

  • Verification of Information: Administrative, typographic, or systemic errors may occasionally occur regarding pricing, availability, or product descriptions. You are solely responsible for independently verifying any critical information before relying on platform materials or finalizing a purchase.

  • Disclaimer of Warranties: Indigenous Dream Walk and its related corporate entities expressly disclaim all warranties, express or implied, regarding the reliability, accuracy, timeliness, utility, or completeness of any materials, product descriptions, or goods hosted on the Sites.

  • Error Reporting: To report a platform discrepancy, incorrect pricing, or product description error, please contact our support team immediately at support@indigenousdreamwalk.com.

7. Product Listings, Specifications, and Disclaimers

  • Product Representations: The Sites may display listings, descriptions, specifications, technical features, and images of goods and services (collectively, “Products”) offered by Indigenous Dream Walk or its affiliated artisans. While we attempt to ensure maximum accuracy, we do not guarantee that any Product listing, description, image, marketing asset, price, or availability metric is complete, accurate, reliable, valid, or current. Product details and inventory availability remain subject to change at any time without prior notice.

  • Color and Aesthetic Variance: We make reasonable efforts to display Product attributes, including colors and finishes, as accurately as possible. However, because color rendering depends heavily on individual monitor settings and device displays, we cannot guarantee that your screen will accurately reflect the precise color, texture, or finish of the physical Product. Weights, measurements, dimensions, and photographs are approximate values provided solely for customer convenience.

  • Age Restrictions: We offer a diverse selection of Products suitable for consumers across multiple age demographics. However, certain Products are intended exclusively for adult consumers. Indigenous Dream Walk does not guarantee the performance, suitability, or utility of any Products or services marketed to any age bracket, including teenagers.

  • Packaging and Material Discrepancies: Although we strive to maintain accurate data across our digital storefronts, physical Product packaging, manufacturing origins, and materials may diverge from the information presented on the Indigenous Dream Walk Sites. Discrepancies may include, without limitation, item descriptions, country of origin markings, intended use guidelines, and ingredient or material lists.

  • User Verification Obligation: You maintain an ongoing responsibility to thoroughly review all physical Product labels, descriptions, warnings, and accompanying instruction materials prior to purchase, deployment, or consumption. For supplemental product details, please contact the specific seller or artisan directly. You assume full responsibility for contacting us with any questions or clarifications regarding a Product’s intended use or transactional procurement.

8. Third-Party Websites and Hyperlinks

  • No Implied Endorsement: The Indigenous Dream Walk Sites may display, reference, or feature third-party names, trademarks, commercial products, or services. Additionally, the Sites may provide hyperlinks directing you to external websites or third-party information platforms. These references and links are provided solely for your convenience and do not constitute or imply an endorsement, sponsorship, or recommendation of the third party, its products, or its services by Indigenous Dream Walk.

  • Disclaimer of Liability: Indigenous Dream Walk exercises no editorial control over, and assumes no responsibility or liability for, the content, privacy policies, data security, operational practices, acts, or omissions of any third-party website, social media network, mobile application, or digital platform that interacts with or links to our Sites.

  • Assumption of Risk: Your interaction with, or navigation to, any third-party website or platform is conducted strictly at your own risk. You acknowledge that your use of external platforms is governed exclusively by the terms of use, privacy policies, and operational guidelines of those respective third parties.

9. Transactional Framework and Order Processing

A. Order Acceptance, Billing Protocols, and Preauthorization

  • Payment Account Representation: You represent and warrant that you possess the lawful right, authority, and capacity to utilize any credit card, debit card, financial account, or alternative payment mechanism (collectively, “Payment Accounts”) that you provide for transactions on the Sites.

  • Storage and Preauthorization: By submitting Payment Account information, you grant Indigenous Dream Walk the explicit authorization to securely store and utilize these credentials as an active payment method for transactions initiated through your account. We reserve the right to request a temporary preauthorization hold from your card issuer for online orders. While this preauthorization is not an actual charge, your financial institution may temporarily restrict the corresponding funds. The duration of this hold is determined exclusively by your card issuer. We deploy reauthorizations solely to verify credential validity and confirm fund availability.

  • Billing Integrity and Cancellations: You maintain an ongoing obligation to provide strictly truthful, current, and accurate billing information. Submitting false, fraudulent, or inaccurate data constitutes a material breach of these Terms of Use and may result in immediate order cancellation or account termination.

  • Order Acknowledgment and Fraud Screening: Following the submission of an order, you will receive an automated email acknowledging receipt of your order request. This acknowledgment does not constitute formal acceptance of your order. We reserve the right to verify information and audit transactions prior to processing. Indigenous Dream Walk maintains the absolute right to refuse, restrict, or cancel any order at our sole discretion for reasons including, but not limited to:

1.    Corporate quantity limits or inventory shortages.

2.    Systemic, administrative, or typographic product and pricing errors.

3.    Risk flags identified through our internal credit, security, and fraud screening protocols.

  • Refund Mechanisms: If we cancel your order after your Payment Account has been successfully charged, we will issue a full refund of the exact charged amount to the original payment method. We will make reasonable commercial efforts to contact you using the account information provided if all or any portion of your order is canceled, or if supplemental verification data is required for acceptance.

Financial Commitment: By finalizing and confirming your purchase at checkout, you enter into a legally binding agreement to pay the full purchase price of the Products, all designated shipping and handling charges, and all applicable localized taxes, tariffs, and government fees. These costs will be calculated and finalized at the time of order confirmation.

  • Quantity Limits and Return Policy Enforcement: We reserve the right, without prior liability or notice, to limit the volume of items purchased per individual, per household, or per transactional order for any reason. We will attempt to notify you if these structural caps apply to your order. In addition to all other legal remedies available under the law, Indigenous Dream Walk reserves the right, at its sole discretion, to restrict, suspend, or terminate your platform account, or refuse any current or future orders, if we detect systemic abuse or violations of the Indigenous Dream Walk Returns Policy.

10. Pricing, Availability, and Promotional Codes

B. Pricing Information and Inventory Availability

  • Post-Order Pricing and Availability Verification: Indigenous Dream Walk cannot definitively confirm the final price or inventory availability of an item until your order has been formally processed. Systemic, administrative, or typographic errors regarding pricing and inventory availability may occasionally occur on the Sites.

  • No Binding Obligation to Sell: A receipt of an order confirmation does not constitute our legal acceptance of your order, nor does it represent a binding confirmation of an offer to sell a Product.

  • Cancellation Rights for Errors: Indigenous Dream Walk reserves the absolute right to cancel any order containing a pricing or availability error at its sole discretion, without further liability or obligation to you. This cancellation right applies even if you have already received an order confirmation, shipping notification, or delivery notice.

  • Remediation Procedures: In the event of a pricing or availability discrepancy, we may, at our sole discretion, either contact you to obtain alternative instructions or cancel the transaction and issue an immediate notification of the cancellation.

·       Pricing Differences Across Sales Channels: Product prices may vary among Indigenous Dream Walk websites, mobile applications, and third-party retail stores that sell our products.

C. Promotional Codes and Digital Coupons

  • Conditional and Discretionary Offers: Promotional codes, discounts, and coupons are temporary, limited time offers. We reserve the right to modify, suspend, or permanently discontinue any promotional code at any time, for any reason, and without prior notice.

  • Legal Transferability Restrictions: All promotional codes are void where prohibited by law. They are strictly non-transferable, may not be duplicated, copied, or sold, and hold no independent cash value. Promotional codes are entirely non-redeemable for cash, credit, or cash equivalents.

11. Shipping, Logistics, and Transfer of Risk

  • Delivery Address Requirements: Products ordered through the Sites will be dispatched to the delivery address specified during checkout, provided that the address is complete, accurate, and complies with all geographical restrictions published on the Indigenous Dream Walk Sites. We restrict shipment and delivery exclusively to addresses pre-saved and authenticated within your account’s address book.

  • Third-Party Fulfillment Carriers: We utilize independent, third-party logistics providers and commercial carriers (including, but not limited to, USPS, UPS, and FedEx) to fulfill and transport your orders.

·       Transfer of Risk and Title: When ordered Products are transferred from our facilities or artisan studios to the designated third-party carrier, title and all risk of loss, damage, or delay pass to you. Indigenous Dream Walk is not responsible for the carrier’s acts, omissions, damage, loss, or transit delays.

  • Non-Guaranteed Delivery Estimates: Estimated delivery windows and transit times depend on the selected shipping method and the final geographical destination. While these windows are presented at checkout for your convenience, they are structural estimates only and are explicitly not guaranteed. Actual delivery timelines may be adversely impacted by carrier capacity constraints, adverse weather events, customs clearance protocols, localized holidays, supply chain shocks, or other force majeure events beyond our reasonable control.

  • Undeliverable Shipments: Indigenous Dream Walk is not liable for undeliverable orders resulting from an inaccurate, incomplete, or inaccessible delivery address, nor are we responsible for delivery failures that occur outside a carrier’s standard operational guidelines or delivery windows.

  • Discretionary Refunds: Any refunds, store credits, or delivery modifications issued due to shipping discrepancies or transit issues remain subject to the sole, absolute discretion of Indigenous Dream Walk.

12. Geographical and Operational Restrictions

  • Variable Delivery Options: Shipping and delivery configurations, timelines, and fulfillment methods are non-uniform and vary dynamically based on product classifications, order volume, destination jurisdictions, legal or regulatory requirements, and carrier-specific constraints.

  • Geographical and Safety Limitations: Certain Products or specialized orders may be legally restricted or logistically unavailable for delivery in specific domestic or international locations. Furthermore, items containing regulated materials or fragile compositions may require specialized handling, unique transport methods, or expedited services.

  • Supplemental Charges and Exclusions: We reserve the right to apply additional logistics restrictions, surcharges, extended-area fees, or delivery exclusions to any transaction. These variables will be determined based on the physical attributes of the Product, localized destination laws, or the real-time operational capacity and availability of our third-party carriers.

13. International Trade and Importation Regulations

  • Cross-Border Eligibility: Select Products hosted on Indigenousdreamwalk.com may be eligible for international shipment outside the United States and its sovereign territories. Eligible inventory may be fulfilled directly by Indigenous Dream Walk or by verified third-party Marketplace sellers.

  • Jurisdictional Transfer of Title and Risk: For all international transactions, the seller completes fulfillment obligations upon delivering the Product to the designated commercial carrier at a designated domestic U.S. shipping hub. At the exact moment of this physical transfer, both the legal title to the merchandise and the entire risk of loss or transit damage pass exclusively to you.

  • Importer of Record Designation: You are formally designated as the Importer of Record for all international shipments. Consequently, you assume sole and absolute legal and financial responsibility for securing compliance with all localized import laws, navigating customs clearance protocols, and liquidating all applicable duties, tariffs, customs fees, and import taxes levied by the destination country.

Customs Brokerage Authorization: To facilitate timely customs clearance and border processing, you hereby grant the designated third-party carrier the explicit authorization to act as your legal agent on your behalf before foreign customs and revenue authorities
